Release & Waiver Agreement

In exchange for participation in the Escape Hunt activities/games organized by EGV Houston LLC located at 125 West Gray Street Houston, Suite 100 Houston, Texas 77019, I personally agree and acknowledge the following:

• I agree to obey all rules and warnings provided verbally or written by employees or representatives of the Escape Hunt franchise.
• By signing this agreement, I release EGV Houston LLC (all its employees and representatives) from any liability, injuries, claims or damages.
• I agree to be financially liable for any damages to the Escape Hunt premises caused by my actions.
• I am responsible for any personal property brought on the premises. Escape Hunt is not liable for any lost, stolen or damaged personal property.
• I agree to allow Escape Hunt to take photos of my person or minor(s) to use for marketing purposes. If I do not consent to pictures being used for marketing purposes, I will notify a staff member.
• I agree to allow Escape Hunt to periodically contact me via eMail to ask for my feedback and to make me aware of special branch news and promotions. If I do not consent to receiving occasional eMail communications from Escape Hunt, I will notify a staff member.

• I declare that I or anyone in my household has not experienced any cold or flu-like symptoms in the last 14 days (to include fever, cough, sore throat, respiratory illness, difficulty breathing).
• By visiting Escape Hunt Houston and playing one of our escape games, I voluntarily assume all risks related to exposure to COVID-19.

• In the event that I consume alcoholic beverages on the premises of Escape Hunt- Houston, I acknowledge that the serving and consuming of alcohol carries potential risks and dangers beyond the control of Escape Hunt - Houston. I assume all liability for any form of negligence that may arise from the consumption of alcohol by me. I hereby agree to indemnify, defend, release, and hold harmless EGV Houston LLC, including the owner, members, agents and employees (collectively “Releasees”) from all liability to me, my next of kin, my conservators, assigns, heirs, guardians or other legal representatives for any and all claims, demands, losses or damages, suits, fines, including court costs and attorneys’ fees, for any injury, death, or damaged property arising out of the consumption of alcohol on the premises. I hereby waive all legal rights to pursue any form of legal action against EGV-Houston LLC and the Releasees. 

 PLEASE NOTIFY AN ESCAPE HUNT EMPLOYEE IF YOU ARE SENSITIVE TO ANY OF THE FOLLOWING:

flashing lights, allergies, and specific scents or any other conditions that you believe should be disclosed for this experience. 

MINORS ONLY (under 18 only)

A legal parent or guardian must sign the following waiver if a minor under 18 is participating in Escape Hunt games/activities.

In exchange for participation in any Escape Hunt activities/games organized by EGV Houston LLC located at 125 West Gray Street Suite 100 Houston, Texas 77019, the undersigned parent or legal guardian will sign the following release on behalf of the minor.

By signing the agreement, the guardian acknowledges the following:

• By signing this agreement, I release EGV Houston LLC (all its employees and representatives) from any liability, injuries, claims or damages.
• I agree to be financially liable for any damages to the Escape Hunt premises caused by my actions or those of the abovementioned minor.
• I am responsible for any personal property brought on the premises. Escape Hunt is not liable for any lost, stolen or damaged personal property.
• I agree to obey all rules and warnings provided verbally or written by employees or representatives of the Escape Hunt franchise.
• I consent to the administration of medical care and authorize any licensed physician, hospital, clinic or emergency personnel to treat the aforementioned minor.
• All expenses incurred in the transportation or treatment of the minor for injuries will be the responsibility of the guardian or parent of the minor.

THE GAME SHOW CHALLENGE

I hereby assume all risks of participating in any/all activities associated with The Game Show Challenge Houston, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault. 

I am not under the influence of drugs or alcohol, which impairs my ability to maintain my safety awareness or endangers others. I agree that all staff or authorized agents may, in their sole discretion, determine it is unsafe for myself or others for my participation to continue, remove me from the premises by any lawful means. 

I understand that I am not on a televised game show.  I understand that The Game Show Challenge Houston is not affiliated with any production company, television station. or televised game shows.

In consideration of my application and permitting me to participate in this activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

(A) I WAIVE, RELEASE, AND DISCHARGE ,The Game Show Challenge Houston from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me, THE FOLLOWING ENTITIES OR PERSONS: The directors, officers, employees, volunteers, representatives, and agents of any and all entities authorizing this activity;

(B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE The Game Show Challenge or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise.

I acknowledge that the Game Show Challenge Houston's directors, officers, employees, volunteers, representatives, and agents of any authorizing entity are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf.

I hereby consent to receive medical treatment, which may be deemed advisable in the event of injury, accident, and/or illness during this activity.

I understand while participating in this activity, I may be photographed. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose this authorizing entity decides, and assigns. I fully understand that there are no refunds under any conditions once I purchase my entrance fee. I agree to pay for any damages due to my negligence or careless actions.

The Accident Waiver and Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

MINOR'S RELEASE: For all persons under eighteen (18) years of age a parent or legal guardian must sign the following acknowledgment. The undersigned the parent and natural or legal guardian of the listed participant (minor's name) hereby acknowledges that he/she has executed the foregoing Release for and on behalf of the minor named herein and agree to bind myself, the minor, his/her executors, administrators, heirs, next of kin, successors, and assigns to the terms of the foregoing Release. I hereby authorize any licensed physician, emergency medical technician, hospital or other medical or health care facility to treat the minor named herein for the purpose of attempting to treat such injuries.  I consent to the administration of all medical care.
