WAIVER OF LIABILITY

In consideration of being permitted to play the Exit Game, I acknowledge and agree to, on my own behalf, and on behalf of my personal representatives,

1. Upon entering the premises and facilities of The Exit Game, I will inspect the same and my observation and use of said premises and facilities shall constitute an acknowledgment that I find and accept such premises to be safe and reasonably suited for their intended purpose(s).
2. I hereby release OC Escape Games LLC and its respective directors, officers, shareholders, employees, agents, contractors, and their successors and assigns (collectively the "Releasees") from and against any and all liability for any loss, damage, injury, expense, demand, or cause of action that I may suffer whether with respect to personal injury, death, damage to or destruction of property, theft, or otherwise that may arise as a result of my presence in, upon, or about the premises as a consequence of my use of the facilities and equipment.
3. I will indemnify and hold harmless the Releasees, collectively and individually, from any and all losses, liabilities, damages, demands, costs, and expenses that they may incur, for any reason whatsoever that may arise as a result of my participation in the contemplated activity, and my presence in, upon or about the premises.
4. I agree to pay no less than $50.00 for any breakage/damages to the room. I understand the rules for playing set forth by the Exit Game.
5. By signing this release form, I authorize Exit Game, to use my photographed likeness in any medium. I hereby grant to Exit Game its subsidiaries, licensees, successors and assigns, the right to use, publish and reproduce, for all purposes, my name, picture of me, and printed electronic copy of the information described above in any and all media including without limitation, cable, and broadcast television and the internet, and for exhibition distribution, promotion, advertising, sale, press conferences, meetings, hearings, educational conferences, and in brochures and other print media in connection with the advertisement and promotion of the games and Exit Game. This permission extends to all languages, media, formats, and markets now known or hereafter devised. This permission shall continue forever unless I revoke the permission in writing. I further grant Exit Game all right, title, and interest that I may have in all finished pictures, negatives, reproductions, and copies of the original print, and further grant Exit Game the right to such materials for marketing, communications, or advertising purposes, as it deems fit. I hereby waive the right to receive any payment for signing this release and waive the right to receive any payment for Exit Game's use of, or any rights to inspect or approve, finished photographs, audio, video, multimedia, or advertising and copy printed matter or computer generated scanned images and other electronic media that may be used in conjunction therewith or to approve the eventual use to which it might be applied.
