WAIVER AND RELEASE OF LIABILITY FORM

Must be signed by a parent or legal guardian for any Participant under 18 years of age.

I/we, the undersigned individuals, hereby agree to abide and be bound by the following terms as a condition of and in consideration for participating in activities associated with International Room Escape AZ, LLC. I/ we acknowledge that this Accident Waiver and Release of Liability Form (“Release”) governs my/our duties, rights, actions, and responsibilities at said activity.

PERSONAL CONDUCT AND REMOVAL: I/ we agree to observe and obey all posted rules and warnings, and further agree to follow any oral or recorded instructions or directions given by International Room Escape AZ, LLC, its employees, representatives, or agents. I/we agree that all staff or authorized agents may, in their sole discretion, determine it is unsafe to myself or others for my/our participation to continue and may remove me/us from the premises by any lawful means.

PERSONAL FITNESS: I/we confirm that I/we have no physical or mental illness that precludes my/our participation in a safe manner for myself or others. I/we am/are not under the influence of drugs or alcohol which impairs my/ our ability to maintain my/ our safety awareness or endangers others. 

RELEASE OF LIABILITY: In consideration for being permitted to participate in a International Room Escape LLC activity,  I/we HEREBY RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE International Room Escape LLC, its officers,  members, owners, employees, independent contractors or business partners, and the owners of the location where the activity takes place (the “Released Parties”) from any and all liability,  claims, demands, actions or right of action, of whatsoever kind or nature, either in law or in equity arising from or by reason of any bodily injury or personal injuries known or unknown, death and/ or property damage resulting or to result from my/our involvement with the activity. 

POTENTIAL RISKS: I/we certify that I/we understand that International Room Escape AZ, LLC activities have potential risks,  including, but not limited to: 

1)    The use of simple tools. 

2)    Moving or lifting objects of not more than twenty pounds. 

3)    Exposure to frightening, disturbing and/or graphic content, props, sounds or lighting effects used to enhance the experience;** 

4)    Mental stress and anxiety. 

5)    Being confined in a reasonably small space with numerous other persons, some of whom may be only recent acquaintances.

6)    Possibility of failure to escape the room in the allotted time. 

7)    Possibility of running into objects or being struck by falling objects. 

**Players who are pregnant, suffer from epilepsy, vertigo, heart problems, claustrophobia or other ailments are advised to consult a doctor before playing. 

ASSUMPTION OF RISK: I/we acknowledge the inherent and actual risks and hazards involved in and arising from attending, participating in, or as a spectator or bystander, of the activity including, but not limited to paralysis and death, and the additional risks of being hit by flying objects, falling, or incurring physical, mental or emotional trauma, stress or injury. I/we assume full responsibility for and risk of bodily injury, death, or property damage due to negligence or non-negligence of the Released Parties relating to the activity. I/we further acknowledge that I/we have inspected the facilities, equipment, and areas to be used for the activity and is voluntarily participating despite the risk of falls, contact and/or crashes with other participants or actors,  defective equipment, the condition of the room and any hazards that may be posed by spectators or volunteers. 

INDEMNIFICATION: I/we agree to defend and indemnify the Released Parties from any and all claims or causes of action by whomever or wherever made or presented as a result of my/our involvement with the activity. Moreover, if such claims are made as a result of my/our conduct, I/ we agree to pay for the legal fees, expenses, and costs incurred by the Released Parties in defending such claims against them.  

AGE LIMITATIONS: I/we understand and acknowledge that I/we may not attend, participate in, or act as a spectator or bystander of the Activity unless I/we am/are eighteen (18) years of age or older or, if younger than eighteen (18) years of age, my/our parent or legal guardian has read, understood and signed this Release.  

MEDICAL CONSENT: I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity. 

IMAGE AND LIKENESS: I/we grant to International Room Escape AZ, LLC the right to use, publish, and reproduce, for all purposes, my/our name(s) and image in printed, film or electronic (video) form, sound and video recordings of me/us, in any and all media and for exhibition, distribution, promotion, advertising, sale, press conferences, meetings, hearings, educational conferences and in brochures and other print media. This permission extends to all languages, media, formats, and markets now known or hereafter devised. This permission shall continue perpetually unless I/ we revoke the permission in wiring. I/we hereby waive the right to receive any payment for signing this Release and waive the right to receive any payment for International Room Escape AZ, LLC’s use of any of the material described above for any of the purposes authorized by this Release. I/we also waive any right to inspect or approve finished photographs, audio, video, multimedia, or advertising recordings and copy or printed matter or computer-generated scanned image and other electronic media that may be used in conjunction therewith or to approve the eventual use that it might be applied. 

NO REFUNDS: I/we fully understand that there are no refunds under any conditions once I/we purchase my/our entrance fee(s). 

LIABILITY FOR DAMAGE: I/we agree to pay for all damages to the facilities of International Room Escape AZ, LLC caused by me/us or my/our family's negligent, reckless, or willful actions, as determined by International Room Escape AZ, LLC, in its sole discretion. 

GOVERNING LAW: This Release shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable Arizona law. 

COVID-19 UPDATE

Since International Room Escape opened its doors in Gilbert, AZ, our games have been a private experience for your guests, you never play a room with strangers, and you will never pay extra for this service. We will continue serving our guest with our private rooms.

It has been a common practice at International Room Escape to sanitize the games between groups as well as sanitize common areas like doorknobs, light switches, props, lobby furniture, etc. The health and safety of our guests is of utmost importance to us, and we are committed to it. We have taken extra measurements to further protect our guests and staff.

·         Hand sanitizer is available to all our guests. Please use it as you enter the game and as you exit.

·         When you receive your booking confirmation email, you will process your check-in. Check-in will also be available onsite via QR code using your own device.

·         The rules and game scenario will be presented to you in the room thru our video broadcast just before your adventure starts.

·         6ft space between your group and our game masters will be maintained.

·         Game masters will be required to stay home if they show any signs of sickness.

BY MAKING THE VOLUNTARY DECISION TO USE OUR AMENITIES, CUSTOMERS AGREE TO TAKE FULL RESPONSIBILITY FOR AND TO ASSUME ALL RISK OF INJURY OR ILLNESS. BY ENTERING IN OUR PREMISES.
